1.1 | General Terms & Conditions

‘Flanders Hotel’ and ‘flanders hotel bruges’ are trade names of Flanders Hotel NV, BE 0467 280 771, Langestraat 38, 8000 Brugge, Belgium, hereafter ‘Flanders Hotel’.

General

These general terms and conditions of sale form an integral part of the hotel contract. However, the written booking conditions shall take precedence over these general terms and conditions of sale to the extent that they conflict with them.

They may only be deviated from in writing.

Please read these Terms and Conditions and the associated privacy policy carefully as you will be bound by them.

Check in and check out

The room awaits you from 14:00hrs (occasionally earlier) and is all yours until 11:00hrs on the day of departure. For if you’re loving the room and are not ready to face the world yet, late check out is available on request and as per availability at a surcharge of € 15 per hour (until 14:00hrs, day of departure). If the guest has not left the room by 14:00 on the scheduled day of departure, an extra night will be charged at the then current rates. Due to stricter measures and for your and our safety, we ask everyone to fill in the registration details of all guests before arrival and also to check in online via our service portal from which you received your personal code when booking. Upon arrival at the hotel, the customer must show his identity card to allow his registration on the police record sheet which he must sign. To check-in  the morning of departure you will receive an email from us where you can also check out online.

Booking guarantee and reservation transfer

Full pre-payment at the time of booking is required for any booking at a non-refundable rate. Other reservations may be guaranteed with a valid credit or debit card and will not be charged at the time of booking.  Please note that a pre-authorization is performed 7 days prior to arrival to check the validity of the credit card provided. A pre-authorization reserves a certain amount that guarantees the reservation. This amount corresponds with the total cost of your reservation. By making a reservation, you give the hotel express permission to perform such pre-authorisation. When the pre-authorization fails, we will contact you in order to obtain an alternative guarantee method, without which we will be forced to cancel your reservation. Please note that the pre-authorisation does not constitute a payment. Upon arrival, you may present us with an alternative payment method, instead of the card used to guarantee the booking. The authorization will be cancelled after your departure.

Room reservations are non-transferrable without prior written agreement by Flanders Hotel. Any such change to a booking may be subject to an administrative fee.

Your Reservation

When your booking is complete, you’ll receive an email containing your reservation number. Please bring this number with you when you check in, along with any credit card used to guarantee the booking as well as the ID or pasport fromm all guest. A driving licence is not vallid ! If this card isn’t yours, we strictly require THIS authorisation form to be completed and signed by the card holder and returned to us prior to arrival. If this is not received, we may not be able to maintain your booking and will keep you informed accordingly.

If you have booked a room in your name but you do not plan to stay, please tell us the name of the new guest as soon as possible.

Validity of reservation and late arrival

A reservation that has been accepted by the hotel owner is only valid until midnight on the day of arrival. In case of delay, the guest is required to inform the hotel owner of this and to state his exact time of arrival.

A late arrival, i.e. arrival after the agreed time, which has not been signalled by the guest, shall automatically cancel the hotel contract, and the hotel owner shall be entitled to damages. This is considered a no-show in which all nights must be paid.

Changes, Cancellations and Non-arrivals

Sometimes things change. If you do need to move the dates of a booking, please contact us via stay@hotelflanders.com / +32 50 338889 or the service portal. Changes are of course subject to availability, but we’ll do our best to help.

For all bookings at a refundable rate, you may cancel free of charge until our plans are set in stone, 48 hours before 14:00 on day of arrival. If you cancel after this time the first night will be payable.  If we don't hear from you at all, the entire stay so free of charge until 48 hours before 14:00 on day of arrival, after which it is fully is payable. If you need to cancel one of the later nights of your stay, you may do payable. At all times and for the record, cancellations must be confirmed in writing, to us and to any third party you may have booked with.

In the case of a booking at a non-refundable rate and booked through a third party, the reservation is neither refundable nor amendable. In the case of a booking at a non-refundable rate and booked directly with us, a change will be subject to the relevant (sur)charges and administration fees. These reduced rates are only possible thanks to their non-refundable nature and we therefore appreciate your understanding that a refund cannot be provided under any circumstance and without exception.

Price

You’ll always find the best rates on our website. These are per room, per night and include Value Added Tax at the prevailing rate. When you book a room either directly or through a third party, you agree to the quoted price and there can be no discussion afterwards.

The price shall be that set out in the contract, unless the hotel owner is forced to adjust the price according to changes in its fixed and/or variable costs.

In this case, the price shall be revised on the basis of the price review formula, which has been drawn up in accordance with current legislation and case law:

The following applies :

P = the new price

p = the original price foreseen in the quotation

a = the percentage of the price not subject to revision (a>=0.20)

b = the percentage of labour costs in the total price

S = the new wage index (the basket prior to paying the invoice)

s = the original wage index (the month preceding the date of the offer)

c = the percentage of material costs in the total price

I = the new material index (the month prior to paying the invoice)

i = the original material index (the month prior to the date of the quotation)

If the hotel owner finds it necessary to revise the rates, it shall notify the contracting party and the guest in writing at least one month in advance or, if this is not possible, as soon as possible (if it is not the same person).

Room Types

The majority of bedrooms have double beds. We have a limited number of twin rooms and a few family rooms. A preference for double, twin, 3 beds or other preference (front, back, high, low, etc.) may be requested but this cannot be guaranteed and is subject to availability. If your request can not be met, this does not entitle you to any refund or discount.

invoice

Invoice in a different name or company is only possible if this information has been adjusted by you on our service portal (link and personal code were emailed to you shortly after making the reservation). For non-refundable reservations, the invoice is automatically created in the name on which the reservation is stated and cannot be changed! For non-refundable reservations with a V-pay card from a third party, the invoice wil be created on the name of the third party as they pay us for the room charge ! Invoices that have already been drawn up cannot be renamed/changed afterwards.

Payment

If a written contract has been concluded between the guest and the hotel, the payment and cancellation conditions contained therein shall apply.

If no contract has been concluded and it is a non-refundable reservation, the total number of nights are payable at the time of booking. If we are unable to collect payment at the time of reservation, the guest will be notified and given 12h to provide a new credit card, otherwise the reservation will be cancelled. 

If there is no written contract between the two parties and they are individual refundable reservations, the guest must provide us with a credit card on which an authorisation is taken and released after departure. All charges must be paid no later than on departure.

if it is agreed in writing that an invoice will be drawn up on a company which can be paid after departure, it must be paid within 7 days of the invoice date into our bank account BE55 2800 4204 0544  Bic : GE BA BE BB.

In case of late payment by the customer, late payment interest shall be due. These late payment interests start to run ipso jure from the day after the due date of the invoice and therefore without the need for prior notice of default. The default interest amounts to 12% per annum and is calculated up to the day of full payment of the principal sum.

In case of late payment by the customer, Flanders Hotel is also entitled to the reimbursement of the costs of recovery in accordance with article 6 of the Act of 2 August 2002. 

The extrajudicial collection costs amount to 15% of the principal sum of the outstanding invoice. The judicial collection costs are equal to the actual costs borne by Flanders Hotel.

Moreover, in case of late payment by the customer, the amount due will be increased by right, and thus without the need for a prior notice of default, by a fixed compensation of 10% of the principal amount, with a minimum of €50.00.

A payment shall always be charged against the oldest outstanding invoice, unless stated otherwise at the time of the payment order by the customer.

Damage

The guest and the contracting party shall be jointly and severally liable to the hotel owner for any damage caused to persons, the building, the fixtures and fittings of the hotel and places accessible to the public.

The hotel owner may therefore sue both the guest and the contracting party for damages.

Therefore, we will charge the credit or debit card from the guest or the contracting party for any damage done to your room or general ereas of the hotel during your stay or for any items that are missing when you leave. It is possible that the hotel will take an authorization on your card at check-in or during your stay to guarantee against any damages

Customer behaviour

The customer must behave in accordance with the conventions and regulations of the hotel where he is staying and these regulations are available for inspection by the customer.

Any serious or repeated breach of these regulations shall entitle the hotel owner to terminate the contract immediately without prior notice and without indemnity.

Pets Policy

We welcome guide dogs at the hotel, however other pets are not allowed in the entire hotel and bar.

Smoking Policy

Flanders Hotel is 100% smoke-free and in accordance with the the smoking ban of the 22nd of December 2009, smoking is prohibited anywhere inside of the hotel. Any breach of the smoking ban will result in a cleaning charge of € 75 being applied, with additional penalty applied at the discretion of Flanders Hotel in case of additional damages, such as subsequent guests refusing to rent the room.

On-site Parking

We recommend to book the use of a parking space in advance (€ 22 per night, available grom 2 PM on day of arrival until 1 PM on your day of departure), as they are available on a first come, first serve basis! Flanders hotel is not responsible for any damage and theft to your private property and belongings.

Breakfast

If your booking doesn't yet include our scrumptious breakfast, we can add it any time before your arrival, at the discounted rate of just € 18,00 per person, per day. Even once you're at the hotel, we can still make the necessary arrangements at the regular rate of € 22,00 per person, per day! Please book your breakfast the night before. A gluten-free and lactose-free breakfast can be provided if we know 3 days in advance. If you have certain allergies, ask the breakfast staff for more details

Children

Bring the kids ! One child aged 0-7 stays free of charge in a club room when occupying the parents room. Further children are charged as adults. Please mention all persons (even free children) when making the reservation. If you arrive with more persons than reserved we can not guarantee that this will be possible and that we will be able to offer you the room that you have booked. No refund will be possible if you will not able to stay at the reserved room due to the fact that you arrive with more persons than booked

Minors

Bookings may not be made by minors. Flanders Hotel reserves the right to refuse access to the residences to any minors who are not accompanied by a legal representative and to cancel the booking. Flanders Hotel may also cancel a stay if it transpires that the hotel it to be used by minors who are not accompanied by a legal representative.

Theft

Flanders Hotel is not responsible for any theft of, or damage to guests’ property caused by other hotel guests or third parties during their stay. A safety box is at disposal for our guests’ in all rooms as well a larger safety box can be obtained at the reception free of charge.

Lost property

Any personal belongings left will only be returned at the guests’ written request. The guest is responsible for any costs and risks associated with returning the item(s).

Force majeure and excessive aggravation of commitment

Any case of force majeure shall automatically release a party from any obligation, without the other party being able to claim compensation.

A case of force majeure is any event which constitutes an insurmountable impediment to the performance of an obligation, beyond the control of the party invoking it. Cases of force majeure are those that are usually recognised as such according to the case law of the Supreme Court.

In any case, but not exhaustively, the following situation constitute force majeure for the hotel owner:

- accidents

- material breakage

- exceptional weather conditions or natural disasters

- fire

- strikes

- war and terrorism

- theft

-pandemics

- government order, including the order for compulsory closure, partial closure or operation under strict conditions

The hotelier claiming force majeure shall notify the customer in writing as soon as possible.

In the event of unforeseen circumstances which cause the performance of the contract to become excessively onerous, to such an extent that its performance can no longer reasonably be required, the contract and/or price of the contract may be adjusted. The unforeseen circumstance may not be attributable to the contractor invoking it.

In the first instance, the parties themselves should renegotiate the hotel contract taking into account the changed circumstances.

Groups

Reservations for more than 5 rooms, no matter whether made up of separately established reservations, are considered as a group and can only be booked directly through the hotel and not through a third party. For groups, an offer is made stating the specific payment and cancellation conditions. When making the group reservation, the guest / company expressly agrees with these conditions that are an addition to our general terms and conditions.

The payment of all known costs must be in our possession before the arrival of the group and this according to the contractual conditions unless otherwise agreed in writing.

A group quote and group reservation is made according to the number of persons, rooms and nights. Any change in this may cause a price change.

The stated number is binding for settlement of the hotel bill

In case of full or partial cancellation of a group, the conditions in the quotation will apply.

If payment is not made on time, the hotel owner shall be entitled to cancel the hotel reservation without notice and without compensation and/or refund of any advances already paid.

The following information must be in the possession of Flanders Hotel as soon as known or at least 1 week before arrival:

Breach of hotel contract

Any serious or repeated breach of the contractual obligations by one of the contracting parties shall entitle the other party to terminate the contract immediately without prior notice and without paying damages to the breaching party.

Photography

When our cameras are rolling we clearly display what we’re up to, however, if you’re included in any of our photography or video and don’t want to be – let us know and we’ll spare your blushes by removing any images of you.

Website Payment

All transactions and credit card details entered on the website are entered on a secured page and transferred using SSL.

Disclaimer

Flanders Hotel declines any liability for damage that might arise from consulting the information contained on other sites or other sources of information in general, and to which this site refers.

Complaints 

Complaints regarding the service performance provided shall only be accepted if sent by registered mail to the hotelier within 7 calendar days after the service has been completed.

Links to outside online information

The Site contains links to other Web sites. We are not responsible for the content, accuracy or opinions express in such Web sites, and such Web sites are not investigated, monitored or checked for accuracy or completeness by us. Inclusion of any linked Web site on our Site does not imply approval or endorsement of the linked Web site by us. If you decide to leave our Site and access these third-party sites, you do so at your own risk.

Personal Information

All personal Information is processed in accordance with local law and are never sold to third parties.

Below you will find the official privacy policy full of difficult jargon that would excite any decent lawyer. We like to keep things clear however, so first we will tell you what we do with your data and why we need it:

1. Your email address – We need this to confirm your booking and send you more information regarding the booking and the hotel. You might even after your stay receive further information from the hotel, however there is always the option to “unsubscribe” if you wish not to receive any further correspondence from us.

2. Your phone number – we generally don’t contact you per phone unless we have an urgent matter with your booking. You may also receive a phone call in case we feel you have not received our email. We could also use your phone to send you  the location of the hotel if you so request it. Your phone number will not be shared with others, and we don’t participate in cold calling

3. Your Name – we assume you would like to be addressed by name, that is why we need your name. It’s just so much nicer that way, don’t you think?

4. We keep your contact details for 2 years. We might occasionally send you more information about events, special discounts or restaurant bookings. If you don’t want us to send you this information, please feel free to unsubscribe from our newsletter, we won’t be offended.

5. Your personal data including your booking history will be kept in a central database in the hotel. Only authorised staff have access to this data, and all have been trained and instructed to care for this data with utmost security. If you would like to update / delete or view the details we keep on you you can email us on stay@hotelflanders.com and we will send you all the details we have on you.

Again, further below you will find the complete and incredibly boring explanation, but let us explain here in layman’s terms what our cookies are all about:

1. We have a facebook pixel installed on our site – this means we can show you advertisement on facebook based on what you have been viewing on our website

The data subject has the possibility to register on the website of the controller with the indication of personal data. The website of Flanders Hotel contains information that enables a quick electronic contact to our enterprise, as well as direct communication with us, which also includes a general address of the so-called electronic mail (e-mail address). If a data subject contacts the controller by e-mail or via a contact form, the personal data transmitted by the data subject are automatically stored. Such personal data transmitted on a voluntary basis by a data subject to the data controller are stored for the purpose of processing or contacting the data subject. The comments made in the blog of Flanders Hotel may be subscribed to by third parties. In particular, there is the possibility that a commenter subscribes to the comments following his comments on a particular blog post.

If a data subject decides to subscribe to the option, the controller will send an automatic confirmation e-mail to check the double opt-in procedure as to whether the owner of the specified e-mail address decided in favor of this option. The option to subscribe to comments may be terminated at any time.

9. Routine erasure and blocking of personal data

The data controller shall process and store the personal data of the data subject only for the period necessary to achieve the purpose of storage, or as far as this is granted by the European legislator or other legislators in laws or regulations to which the controller is subject to.

If the storage purpose is not applicable, or if a storage period prescribed by the European legislator or another competent legislator expires, the personal data are routinely blocked or erased in accordance with legal requirements.

If no employment contract is concluded with the applicant by the controller, the application documents shall be automatically erased two months after notification of the refusal decision, provided that no other legitimate interests of the controller are opposed to the erasure. Other legitimate interest in this relation is, e.g. a burden of proof in a procedure under the General Equal Treatment Act (AGG).

This would be the case, for example, if a visitor were injured in our company and his name, age, health insurance data or other vital information would have to be passed on to a doctor, hospital or other third party. Then the processing would be based on Art. 6(1) lit. d GDPR.

Finally, processing operations could be based on Article 6(1) lit. f GDPR. This legal basis is used for processing operations which are not covered by any of the abovementioned legal grounds, if processing is necessary for the purposes of the legitimate interests pursued by our company or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data. Such processing operations are particularly permissible because they have been specifically mentioned by the European legislator. He considered that a legitimate interest could be assumed if the data subject is a client of the controller (Recital 47 Sentence 2 GDPR).

27. The legitimate interests pursued by the controller or by a third party

Where the processing of personal data is based on Article 6(1) lit. f GDPR our legitimate interest is to carry out our business in favor of the well-being of all our employees and the shareholders.

24. Period for which the personal data will be stored

The criteria used to determine the period of storage of personal data is the respective statutory retention period. After expiration of that period, the corresponding data is routinely deleted, as long as it is no longer necessary for the fulfillment of the contract or the initiation of a contract.

We clarify that the provision of personal data is partly required by law (e.g. tax regulations) or can also result from contractual provisions (e.g. information on the contractual partner).

Sometimes it may be necessary to conclude a contract that the data subject provides us with personal data, which must subsequently be processed by us. The data subject is, for example, obliged to provide us with personal data when our company signs a contract with him or her. The non-provision of the personal data would have the consequence that the contract with the data subject could not be concluded.

Before personal data is provided by the data subject, the data subject must contact any employee. The employee clarifies to the data subject whether the provision of the personal data is required by law or contract or is necessary for the conclusion of the contract, whether there is an obligation to provide the personal data and the consequences of non-provision of the personal data.

26. Existence of automated decision-making

As a responsible company, we do not use automatic decision-making or profiling.
